What Are the Stages of Criminal Proceedings?

Criminal proceedings consist of two main stages: the investigation, which begins when a suspicion of crime arises, and the prosecution, which begins when the indictment is accepted. A mistake at one stage directly affects the next, so the defence should be planned from the very first statement.

  1. Statement and custody: A suspect may exercise the right to remain silent and the right to a lawyer at every stage (Code of Criminal Procedure art. 147).
  2. Arrest and judicial control: Detention requests are decided by the criminal judgeship of peace. An objection to a detention order can be filed within 7 days (art. 268), and release under judicial control can be requested at any stage.
  3. Indictment: If the evidence creates sufficient suspicion, the prosecutor files an indictment; otherwise a decision of non-prosecution is issued.
  4. Trial: Witnesses are heard and expert reports and digital evidence are examined; the defence is built on this evidence.
  5. Judgment and appeals: The judgment can be challenged through appeal and cassation within the periods set by law.

Frequently Asked Questions

Do I have to bring a lawyer to give a statement?

It is not mandatory, but a suspect has the right to a lawyer at every stage. Reviewing the allegations and your statement with a lawyer beforehand prevents mistakes that are hard to correct later.

What is deferral of the announcement of the verdict (HAGB)?

Where the sentence is two years' imprisonment or less, or a judicial fine, the court may defer announcing the verdict if the legal conditions are met. If no new intentional offence is committed during the five-year supervision period, the verdict is set aside and the case is dropped (art. 231).

How can a detention order be challenged?

An objection is filed with the criminal judgeship of peace that issued the order within 7 days, arguing for example that the grounds for detention are not concrete and that judicial control would be sufficient.

What can I do as a victim?

You can file a complaint with the prosecutor or the police, join the case as an intervening party during the trial and claim compensation. For offences prosecuted upon complaint, the 6-month period must not be missed.
