How Do Employment Claims Proceed?

In disputes between employees and employers over receivables, compensation and reinstatement, applying to a mediator before filing suit is a precondition (Labour Courts Law No. 7036, art. 3). The process therefore usually starts with an application to the mediation office at the courthouse.

  1. Calculation and documents: Payslips, the social security service record, bank records and the termination notice are reviewed to calculate the claims.
  2. Mediation: The mediator concludes the process within 3 weeks, extendable by up to 1 week where necessary.
  3. Agreement or lawsuit: An agreement has the force of a court judgment. If there is no agreement, the case is filed at the labour court.
  4. Expert review: The court has claims such as overtime and severance pay calculated by an expert.
  5. Judgment and collection: Enforcement proceedings can be started against the employer for final awards.

Frequently Asked Questions

I was dismissed. What should I do first?

Keep the termination notice and any documents you were asked to sign, and obtain your payslips and social security service record. If you want reinstatement, apply to a mediator without delay, as the 1-month period is very short.

Can an employee who resigns receive severance pay?

As a rule, no. However, severance pay is due for justified resignations, for example when wages or overtime are not paid or the employee is not insured, and in cases such as retirement or a female employee leaving within 1 year of marriage.

What happens if mediation fails?

The mediator issues a report of non-agreement, and the case can then be filed at the labour court. A party that misses the first meeting without a valid excuse bears all litigation costs even if it later wins the case.

Can uninsured working days be recognised later?

Yes. Uninsured or under-reported work can be established through a service determination action, which must be filed within 5 years from the end of the year in which the work was performed.
