How Does Mediation Work?

Mediation is a confidential and voluntary method in which an impartial mediator registered with the Ministry of Justice brings the parties together and helps them reach their own solution. In disputes where mediation is a precondition to suing, the process starts with an application to the mediation office at the courthouse.

  1. Application: For mandatory mediation, the application is made to the courthouse mediation office. If the parties agree on a registered mediator, that mediator is appointed; in voluntary mediation the parties choose the mediator directly.
  2. Invitation and first meeting: The mediator invites the parties and explains the process and confidentiality rules.
  3. Negotiation: Joint and separate sessions address the parties' real needs and possible solutions.
  4. Time limits: In employment and consumer disputes the mediator concludes within 3 weeks, in commercial disputes within 6 weeks; these can be extended by 1 and 2 weeks respectively.
  5. Outcome: An agreement document is drawn up if the parties agree, otherwise a final report.

Disputes Where Mediation Is Mandatory

Frequently Asked Questions

What happens if I do not attend the mediation meeting?

In mandatory mediation, a party that misses the first meeting without a valid excuse bears all litigation costs in the later lawsuit even if it wins, and no attorney fee is awarded in its favour.

Is a mediation agreement binding?

Yes. An agreement signed by the parties, their lawyers and the mediator has the force of a court judgment and can be enforced directly. No lawsuit can be filed later on the matters agreed.

Can I choose the mediator myself?

In voluntary mediation the parties choose freely. In mandatory mediation the mediator is appointed by the mediation office from the list, unless the parties agree on a registered mediator.

Who pays the mediation fee?

If an agreement is reached, the fee is shared equally unless agreed otherwise. If mandatory mediation ends without agreement, the fee for up to two hours is covered by the Ministry of Justice.
