Cerkezkoy real estate lawyer Fatih Özden - Title deed disputes, partition lawsuits, and rental eviction cases

How Do Real Estate Cases Proceed?

The first step in a property dispute is reviewing the title deed record and any annotations, mortgages or attachments on it. Choosing the right type of action and, where necessary, registering an interim injunction on the title to prevent a transfer directly shape the outcome.

  1. Record review: The title deed, zoning status, condominium records and any lease agreement are examined.
  2. Mandatory mediation: Since 1 September 2023, applying to a mediator before filing suit is a precondition in lease, condominium, neighbour-law and partition disputes.
  3. Lawsuit and injunction: If no agreement is reached, the case is filed and, where needed, an interim injunction is annotated on the title.
  4. On-site inspection and experts: The court inspects the property; value, use and condition are determined by expert reports.
  5. Judgment and registration: The final judgment is sent to the land registry and registered.
